General Terms and Conditions of jetbeds

The following General Terms and Conditions (GTC) regulate the contractual relationship between you as the booking party and jetbeds as the agent and the service providers of the individual travel services and/or the tour operators for the travel contract within the meaning of § 651 ff BGB (German Civil Code). jetbeds expressly points out to all booking parties, participants and travellers that travel contracts are not concluded with jetbeds, but always with the respective service provider specified, taking into account the General Terms and Conditions (GTC) of the respective service provider. Details as well as the complete conditions can be obtained from our Service Center. With jetbeds a mediation order comes about. Therefore the following terms and conditions apply exclusively to our brokerage activities and have no influence on the terms and conditions of the tour operators or airlines to which the brokered trips are made. jetbeds is not obliged to check the information provided by the service providers and is not liable to a booker / participant / traveller for the correctness of the information provided by his possible contractual partners, unless jetbeds transmits this data grossly negligently or intentionally incorrectly or transmits this data despite serious misgivings regarding its correctness. The following General Terms and Conditions apply exclusively to the brokerage contract. The validity of any general terms and conditions of the booker / participant / traveller is expressly excluded, insofar as they do not comply with the following general terms and conditions. The mediation contract is concluded with the issue of the tickets or the sending of the booking confirmation by jetbeds. All services beyond the mediation service are to be remunerated separately to jetbeds, due to a new contract between you as the booking party and jetbeds. Everything regarding these costs will be subject of the following terms and conditions.

Website

jetbeds is run by jetbeds GmbH. The contract between the booking party / participant / traveler is subject to German law.

Processing

The execution and handling of your booking order is carried out by jetbeds GmbH.

Contract content

The binding booking order comes into effect as soon as the person making the booking has clicked on the "Pay & Book" button in the mask. This is the legally binding order to jetbeds to arrange a transport or other individual tourist service for the booking party with a certain service provider or a travel contract with a tour operator. The provision of the booked service as such is not part of our obligations as a travel agent. The person booking is bound to this booking order for 72 hours. Within this period jetbeds accepts the booking order or gets in touch with the booking party. Acceptance is basically the binding confirmation in the form of an invoice from jetbeds with the consequence that the payment owed is due immediately, if it is not an order to conclude a travel contract with a tour operator. If it is a matter of booking a travel event with a tour operator, the latter's provisions on payment and security procedures shall apply.

In the case of payment by credit card, the debit of the credit card account of the person booking / participant / traveller equals the booking acceptance.

The mediation is deemed to have taken place as soon as the booking confirmation / invoice / travel documents / (e-)tickets have been sent to the customer. You are obliged to immediately check the booking confirmation / invoice / travel documents / (e-)tickets you have received for correctness and to inform jetbeds immediately if you notice any inaccuracies or deviations. We inform you that we do not save the contract text. With our booking confirmation by e-mail you will receive an overview of your chosen travel service and its costs.

The person who makes the booking or the debtor specified by him is generally liable to pay the total invoiced travel fee, including processing and service fees (travel price). The person making the booking is liable for the full travel price if the travel price is not paid by the person liable to pay.

The order to jetbeds consists of the pure mediation of the booked flights and is concluded with the issuance of the booking confirmation / invoice / travel documents / (e-)tickets. Any change to a completed booking by the booking party is not part of this agency order and must therefore be remunerated separately. Further information on the costs incurred can be found under "Rebooking and cancellation" as well as "Fees for additional services provided by jetbeds" in these General Terms and Conditions.

Price optimization by jetbeds

jetbeds will optimize the price of the flight connection chosen by the customer after the placing of a binding booking order by the customer. In case of a price optimisation jetbeds will agree with the airline on a price deviating from the customer's booking order (including taxes and fees). The service components of the flight connection selected by the customer remain unchanged. If additional costs arise as a result of the price optimisation (the airfare agreed by jetbeds is higher than the airfare stated in the customer's booking order), jetbeds shall bear the additional costs. If the fare agreed by jetbeds is lower than the fare stated in the customer's booking order, jetbeds shall be entitled to the difference. For the customer in any case the airfare stated in the binding booking order is decisive.

Liability of jetbeds

jetbeds makes every effort to ensure that the information, software and other data available on the website, in particular with regard to prices, restrictions and dates, are up-to-date, complete and correct at the time of publication. Any liability of jetbeds is limited to intent and gross negligence, unless essential contractual obligations are violated (cardinal obligations). jetbeds is liable for slight negligence only for typical and foreseeable damages. The liability of jetbeds in case of slight negligence is limited to the maximum amount of the booked service from which the claim results. jetbeds accepts no liability whatsoever for the performance of the services provided by the service providers. All claims for damages expire within 12 months after their creation. This does not apply to claims arising from tort.

The above limitations of liability shall not apply to claims arising from the Product Liability Act or any other guarantee liability. The same applies in case of injuries to life caused by jetbeds or physical or health damages caused by jetbeds as well as in case of gross negligence or intent on the part of jetbeds. As far as the liability of jetbeds is excluded, this exclusion of liability also applies to the employees, legal representatives and vicarious agents of jetbeds.

Mediation fee

jetbeds charges a service fee for the mediation of the journey. This fee will not be refunded if the trip is cancelled, unless the cancellation is due to a fault of jetbeds and/or its vicarious agents. The customer is free to prove that no or a small expenditure has arisen.

Rebooking and cancellation

The rebooking of a booked and confirmed trip is only possible through withdrawal from the booked and simultaneous re-booking of another trip, unless the service provider has provided special provisions for this. Possible expenses for rebooking or partial travel compensation to be paid depend on the conditions of the respective service provider.

The possibility to cancel a booking depends exclusively on the travel contracts / transport contracts or general terms and conditions of the respective service provider and cannot be influenced by jetbeds. Depending on the ticket rate, the time of cancellation and the service provider, in some cases there may be no refund from the service provider or airline. Please contact our Service Center for details and full terms and conditions. A partial refund for not departed flights is generally excluded according to the conditions of the airlines. jetbeds will give the booking party information to the best of its knowledge and belief, but is not liable for the accuracy or completeness of the information provided by the airlines.

The decisive point in time for the withdrawal is the arrival at jetbeds within the usual business hours. We recommend to make the cancellation in written form in order to avoid misunderstandings. Cancellation can be made by e-mail to service@jetbeds.com or by mail to jetbeds GmbH, Luitpoldstr. 9, 63739 Aschaffenburg, Germany, stating the booking number. For payment of any refund/partial refund it is mandatory that the original tickets are sent to jetbeds unless an electronic ticket has been issued.

Free cancellation within 24 hours. Does not apply to bookings made within 72 hours of departure.

The date on which we receive your cancellation request is decisive for the timeliness of the cancellation.

Since rebookings and/or cancellations, which are initiated voluntarily by you as the booking party via jetbeds, are services which are not covered by the mediation contract between you and jetbeds, jetbeds charges its own service fees for the processing of rebookings and/or cancellations of services as well as the withdrawal of tickets, if the measure is not based on a fault of jetbeds.

1. in case of voluntary cancellation of flight tickets by you as the booking party, after ticket issue, via jetbeds, a cancellation fee of 75 Euro / ticket will be charged in addition to the costs according to the regulations of the service provider.

2. in case of a possible rebooking by you as the booking party via jetbeds, if possible according to the regulations and/or vacancies of the airline, a fee of 50 Euro / ticket will be charged in addition to the costs to be paid according to the regulations of the service provider.

3. in case of a possible name change by you as the booking party via jetbeds, if approved by the airline, a fee of 100 Euro / ticket will be charged in addition to the costs of the service provider. This also applies to minor deviations in the spelling of the name or the exchange of first and last names.

The customer is at liberty to prove that no or less expenditure has been incurred.

jetbeds recommends the booking party to take out a travel cancellation insurance.

Unless stated otherwise in the individual travel descriptions or booking confirmations, the following conditions apply:

Scheduled flights and flight offers

The conditions of the respective airline apply. We would like to point out that in many cases a rebooking or cancellation is subject to a charge or may even not be possible at all.

Hotel

The conditions of the respective provider, which is displayed in the booking process, apply.

Rental car

Special conditions apply for rental car bookings. Please read the general terms and conditions of the respective car rental company.

Special and charter flights

The General Terms and Conditions of the respective service provider / airline apply. All special and charter flights must be reconfirmed by the customer at the latest 48 hours before return flight with the respective airline or the organizer. If this reconfirmation is not made, there is no entitlement to carriage. The conditions of carriage of the airlines are binding.

Payment

Flights and / or other tourist services are to be paid immediately and in full upon acceptance of your booking order. In the case of payment via online banking (direct debit, Giropay), payment is already made when the order is placed.

In the case of payment via credit card, the disclosure of the card data equals the consent to the collection of the agreed amounts. Credit card holders other than the traveller will only be accepted with the prior written or, in exceptional cases, (remote) verbal consent of the respective account or card holder.

jetbeds reserves the right to cancel flights not paid for in due time and all other tourist services not paid for in due time and to pass on any related charges to the customer. The charges also include additional costs incurred by the airlines or credit card institutes in the event of a credit card return debit being made to the merchant. The customer is free to prove that less or no costs were incurred. Only the means of payment indicated in the booking process will be accepted. There is no obligation to issue tickets, confirmations, vouchers or other travel documents to you prior to receiving full payment. However, the booker / participant / traveller remains in any case obliged to pay the agreed amounts for ordered travel services.

jetbeds reserves the right to charge you back any charges for credit card payments or direct debit returns. The customer is at liberty to prove that no or little expense has been incurred in this respect.

Fees for additional services provided by jetbeds

1. sending documents by mail: 8 Euro / postal item

Travel documents

If an e-ticket (electronic, paperless ticket) has not been booked or it is not possible to issue an e-ticket, the travel documents will be sent by mail. If payment is made via bank transfer, the travel documents will be sent after receipt of payment. In the case of short-term bookings, the travel documents will be deposited at the airport or sent via express service. Costs for dispatch as well as possible deposit fees are borne by the customer. These will not be refunded in case of cancellation of the trip, unless the cancellation is due to a fault of jetbeds and/or its vicarious agents. Lost tickets will be refunded according to the airline's policy. For replacement tickets the fees valid at the time will be charged. The customer is at liberty to prove that no or lower costs were incurred in this respect.

Services and changes to services

The scope of the contractual services results from the service description in the offer or from the information in the travel confirmation. The service providers expressly reserve the right to change the airline, the aircraft, the flight schedule, or to convert non-stop flights into flights with stopovers or transfer flights if this becomes necessary.

Changes in flight times

Flight time changes and/or flight cancellations will only be reported to the e-mail address provided at the time of booking, unless expressly agreed otherwise. We would like to point out that all flights must be reconfirmed with the respective airline 48 hours before the start of the outward and return flight. If this reconfirmation does not take place and if the missing reconfirmation is the cause for a possible damage occurrence, jetbeds is not liable for such damages.

Insurances

A travel cancellation insurance is not included in the prices. We recommend that you take out travel insurance, which we will be happy to arrange for you.

Visa, passport, customs etc.

Each participant / traveller is basically responsible for ensuring that the conditions necessary to carry out the trip are fulfilled for his person and that all legal regulations, in particular the domestic and foreign entry and exit regulations, health regulations, passport and visa regulations are observed. The same applies to the procurement of necessary travel documents. Within the scope of our statutory duty to provide information, we will provide you with conscientious information on these questions upon request, but cannot assume any liability for it. We expressly point out that the regulations can be changed at any time by the authorities. The participant is therefore advised to obtain information himself from the responsible authorities and institutions. If references to passport, visa, currency or health regulations for your destination are given on this website, it is assumed that you are a German citizen. If this is not the case, please contact the embassy or consulate responsible for you with regard to this information.

Force Majeure

In the event of force majeure which prevents jetbeds from fulfilling its obligations in whole or in part, jetbeds shall be released from its obligations until such time as the force majeure ceases to exist.

Abusive use

Each person booking bears the risk for the unauthorized use of his password. jetbeds can only point out that the password and the user name have to be kept secret in any case.

Data security

The booking order shall be processed in accordance with the applicable data security regulations. jetbeds undertakes to use the data collected, processed and stored during the registration and use of jetbeds services by the respective participant solely for the purpose of processing contracts concluded with the cooperation of jetbeds and to pass them on to outside third parties only within the scope of the statutory provisions or regulations. As far as this is necessary for the execution of concluded contracts, the participant data collected during registration will be forwarded to the respective service providers.

Use of data for e-mail advertising without newsletter subscription and your right of objection

If we receive your e-mail address in connection with the sale of a product or service and you have not objected to this, we reserve the right to send you regular offers for similar products to those already purchased from our range by e-mail. You can object to this use of your e-mail address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising e-mail, without incurring any costs other than the transmission costs according to the basic tariffs.

Credit assessment

jetbeds obtains credit information from credit agencies in the event of payment defaults. In case of default your data will be sent to the following company:

Changes to the General Terms and Conditions

jetbeds reserves the right to change or renew the General Terms and Conditions for the use of this website at any time with effect for the future, without any obligation to notify the user. The current version of the General Terms and Conditions will be made available on the website from the time they come into force.

Dispute settlement

(1) The EU Commission offers the possibility of online dispute resolution on a platform operated by the EU Commission. This platform can be reached via the external link http://ec.europa.eu/consumer/odr/ . jetbeds GmbH currently does not participate in this alternative dispute resolution procedure.

2. The responsible arbitration board for German customers for dispute occupations after § 37 consumer dispute occupancy law is the general consumer arbitration board of the center for arbitration registered association - Strassburger Str. 8 in 77694 Kehl. The jetbeds GmbH at present does not take part in dispute settlement procedures before consumer arbitration boards.

Miscellaneous

Should any of the above provisions prove to be invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby. jetbeds hereby expressly points out that the procurement of travel services pursuant to § 312 b Para. 2 No. 5 BGB is not subject to the Distance Selling Act. This also applies in to the sale of airline tickets in particular. This means that the customer is not entitled to any right of cancellation or return vis-à-vis jetbeds. For disputes arising from or in connection with this contract, German law applies exclusively. The registrant/traveller can only sue jetbeds at the registered office of jetbeds - in Aschaffenburg - if he is a registered trader.
